Kroger Corporation Race DiscriminationA Federal lawsuit has been filed against the Cincinnati-based supermarket giant Kroger Corporation alleging that the company systematically discriminates against African American salaried and hourly workers. According to the suit, Kroger routinely impedes the advancement of African American employees and pays them less than similar white employees. The company employs over 300,000 workers and this suit was filed on behalf of African American employees who work in Kroger stores nationwide. The action was filed Thursday, November 29, 2001 in the U.S. District Court of the Western District of Kentucky in Louisville, Kentucky, on behalf of African-Americans who have been employed by Kroger at any time since October 1998 and who have been subjected to racially discriminatory employment practices. Plaintiffs have obtained many documents from Kroger as part of the discovery process, and will soon begin to take deposition testimony about Kroger's practices, and analyze computerized employment data to develop statistical evidence in support of the case. A motion asking the court to certify the case as a class action is expected to be filed in Spring 2005.
