Korean Air Lines and Asiana Airlines

Chung et al. v. Korean Air Lines Co., Ltd., Case No. C-07-3985, United States District Court for the Northern District of California

On August 2, 2007 the law firm Cohen Milstein Hausfeld & Toll filed the first of several antitrust class actions seeking damages on behalf of all individuals who have been victimized by price fixing on passenger tickets, including fuel surcharges.  According to the Complaints filed in that case, Korean Air Lines and Asiana Airlines conspired to agree upon the timing and amounts of its fuel surcharge and price increases, over several years. The Complaints allege that these airlines’ illegal activity targeted individuals and corporations purchasing one-way or round trip tickets for certain flights to and from South Korea.  On August 1, 2007 it was announced by the U.S. Department of Justice that Korean Air Lines pleaded guilty for its role in this air passenger price fixing conspiracy. The Justice Department also reported that Korean Air Lines had agreed to pay a $300 million fine for this cartel activity, as well as for its participation in a similar conspiracy involving air cargo shipping.
