Keepseagle Notification of Monetary Relief RequestOn December 11, 2001, the Court certified this case as a class action, and permitted the class to seek injunctive and declaratory relief. The Court, at that time, deferred on ruling whether the class should be certified as to the monetary relief claims because the record did not contain sufficient information on which to make such a determination.
Subsequently, the Court requested that Plaintiffs indicate by March 23, 2005 whether they intend to seek monetary relief for the class, and their basis for doing so. The following brief, filed with the Court on December 17, 2004, presents Plaintiffs’ claims for monetary relief for the USDA’s failure to provide Native American farmers credit comparable to that granted White farmers. A brief regarding Plaintiffs’ monetary claims for the USDA’s failure to provide Native American farmers debt servicing will be filed with the Court shortly.
