Settlements Totaling Over $105 Million with Niacin and Biotin Defendants in Vitamins Antitrust Litigation Finally Approved

On February 18, 2004, Chief Judge Hogan finally approved four settlements between Class Plaintiffs and defendants Sumitomo Chemical Co., Ltd., Sumitomo Chemical America, Inc., Tanabe Seiyaku Co., Ltd., Tanabe USA, Inc., Reilly Industries, Inc., Reilly Chemicals, S.A., Lonza Inc., Lonza AG, Degussa AG, Degussa Corp., and Nepera, Inc. (the "Biotin and Niacin Defendants") in the Vitamins Antitrust Litigation.

Pursuant to the Settlement Agreements, the Biotin and Niacin Defendants have made cash payments totaling $105,930,000, plus interest, for the benefit of the members of the Vitamin Products Class, a class of businesses that directly purchased bulk vitamins from the Niacin and Biotin Defendants and other vitamin manufacturers and were overcharged as a result of an illegal price-fixing conspiracy. Four other major settlements in this multidistrict litigation between certain defendants and Class Plaintiffs have been previously approved by Chief Judge Hogan (D.D.C.).
