50 Million Settlement Reached with Merck Defendants in Vitamins Antitrust Litigation

Class Plaintiffs reached a settlement with defendants E. Merck, Merck KGaA, and EM Industries, Inc. (jointly referred to as "Merck") in the Vitamins Antitrust Litigation and filed a motion for preliminary approval of their settlement on August 15, 2002. Pursuant to the Settlement Agreement, Merck has made a cash payment of $50 million for the benefit of the members of the Vitamin Products Class, a class of businesses that directly purchased bulk vitamins from Merck and were overcharged as a result of an illegal price-fixing conspiracy. CMHT, along with Boies, Schiller & Flexner and Susman Godfrey, are Co-Lead Counsel for the Class Plaintiffs. Three other major settlements in this multidistrict litigation between certain defendants and Class Plaintiffs have been previously approved by Chief Judge Hogan (D.D.C.).
