Niagara Frontier Distribution, Inc. v. Air France ADS, et al., Case No. 1:06CV00325 (HHK) (D.D.C.)

Cohen Milstein brought this antitrust class action in February 2006 on behalf of a distribution company that used the airfreight shipping services of one or more of well over a dozen major international airlines, including British Airways, Air France-KLM, Lufthansa, SAS Group and United Airlines, between January 1, 2000 and the present.  These airlines, and many others, are currently under investigation for cartel behavior, relating to inflated airfreight surcharges, in a global sting operation coordinated by governmental antitrust enforcement authorities from regions including the U.S., the E.C., Canada, Switzerland, and Korea. 

According to the Complaint, the plaintiff, on behalf of itself and those similarly situated, seeks to recover the supra-competitive overcharges paid by it and other direct purchasers as a result of the airlines’ conspiracy to levy these coordinated, inflated surcharges on their airfreight customers, in violation of the Sherman Act, 15 U.S.C. § 1; victims of the cartel include all those paying such inflated surcharges. As the defendant airlines’ alleged cartel activities were perpetrated world-wide on a vast number of inter-continental airfreight shipments, victims of the alleged conspiracy hail from potentially all parts of the globe.
